These Terms of Service (“Terms”) apply to your use of Atelierdemarie.com and to purchases made through our online store.

Please read these Terms carefully before placing an order. By placing an order through Atelierdemarie.com, you agree to these Terms and to the policies and product information made available to you before checkout.

Nothing in these Terms limits or excludes any consumer right that cannot lawfully be limited or excluded.

In these Terms, “Atelierdemarie.com”, “we”, “us”, and “our” refer to Worldwide Apparel Group LLC. “You” and “customer” refer to the person accessing the website or purchasing products from us.

1. About our store

Atelierdemarie.com is an online jewellery store operated by Worldwide Apparel Group LLC.

Products offered through the store are subject to the descriptions, prices, availability, specifications, and other information displayed on the relevant product page at the time of purchase.

We do not claim that Atelierdemarie.com operates a physical retail location, warehouse, manufacturing facility, or other establishment unless that information is expressly stated and verified on the website.

2. Eligibility to purchase

By placing an order, you confirm that you are legally capable of entering into a binding contract.

If you are purchasing on behalf of another person or organisation, you confirm that you are authorised to do so.

You are responsible for ensuring that the information you provide when placing an order is accurate and complete.

3. Product information

We aim to describe and display our products accurately.

Please review the relevant product page before placing an order, including all available information concerning the product's materials, dimensions, size, colour, finish, stones, decorative elements, care instructions, and other characteristics where applicable.

Descriptions of metals, plating, gemstones, materials, finishes, or other objective product characteristics apply only where those characteristics are expressly stated on the relevant product page.

Product photographs are intended to represent the products as accurately as reasonably possible. However, minor differences in colour or appearance may occur because of lighting, photography, screen settings, or individual device displays.

Nothing in this section affects your rights where a product is materially different from its description.

4. Product availability

All products are subject to availability.

Placing an item in your shopping cart does not reserve that item.

If a product becomes unavailable after you have placed an order, we will contact you. If we cannot supply the affected product, any amount already paid for that product will be refunded to the original payment method.

We may refuse or cancel an order before fulfilment where reasonably necessary because of an inventory error, an obvious pricing or technical error, an unsuccessful or unauthorised payment, suspected fraud, or a legal restriction preventing us from completing the order.

If we cancel an order after payment has been collected, we will refund the applicable amount.

5. Prices

The price payable for a product is the price shown to you at checkout when you place your order.

The applicable currency and any delivery charges or other amounts collected by us will be displayed before you submit the order.

We may change prices for future orders at any time. A later price change will not affect an order that has already been accepted.

Any sale, discount, former-price, or promotional claim displayed on Atelierdemarie.com must relate to the offer actually available to the customer.

6. Placing an order

Before submitting your order, you should check the products selected, quantities, variants, delivery information, billing information, contact details, and total amount payable.

You are responsible for correcting any errors before submitting the order.

After an order is placed, we will send an electronic order confirmation to the email address you provided.

Unless otherwise stated during checkout, a contract between you and Worldwide Apparel Group LLC is formed when we accept your order and send you confirmation of that acceptance.

Please retain your order confirmation for your records.

7. Payment methods

Atelierdemarie.com accepts the following payment methods:

The payment methods actually available for a particular transaction are those displayed at checkout.

Digital-wallet availability may depend on your device, browser, location, or other technical eligibility requirements.

Payment must be successfully authorised before an order can be fulfilled.

Your bank, card issuer, or payment provider may apply its own terms or independent charges. Those external terms are outside our control.

8. Shipping and delivery

Our standard order-processing time is 1–3 business days.

After dispatch, the standard estimated transit time is 6–12 business days.

The total estimated delivery time is therefore 7–15 business days.

Our standard order cut-off is 17:00 Mountain Time (MT — MST/MDT), Monday through Friday.

Orders placed after the applicable cut-off, on weekends, or on applicable public holidays begin processing on the next business day.

For the purposes of these shipping estimates, business days are Monday through Friday, excluding applicable public holidays.

Delivery dates are estimates rather than guarantees unless we expressly agree otherwise.

Where tracking information is available, it may be provided after dispatch.

If we become aware that we cannot ship an order within the promised or agreed timeframe, we will handle the delay in accordance with applicable law. Depending on the circumstances and applicable law, this may include providing a revised timeframe, allowing you to accept the delay, or providing a cancellation and refund option.

UK consumers retain their mandatory statutory delivery rights.

9. Our 30-day voluntary return policy

In addition to any statutory rights that apply to you, Atelierdemarie.com offers a 30-calendar-day voluntary return period for eligible products.

The voluntary return period begins on the date you receive the relevant product.

For an ordinary change-of-mind return under this voluntary policy, the product should be returned in its original condition, unused, unworn, and with its original packaging, accessories, or included components where applicable.

For an ordinary change-of-mind return, the customer is responsible for arranging and paying the direct cost of return shipping where permitted by applicable law.

The voluntary 30-day return policy does not replace or reduce any mandatory statutory rights relating to cancellation, defective goods, incorrect goods, damaged goods, or products that do not conform to their description.

10. Refunds under our voluntary return policy

Once an eligible voluntary return has been received and processed, any refund due will normally be issued to the original payment method.

After we issue a refund, your bank, card issuer, or payment provider may require additional time to credit the funds to your account.

Any payment-provider processing period does not extend a statutory deadline that applies to us.

Original delivery charges are refunded only where required by applicable law or expressly provided for under the applicable return terms.

11. UK statutory right to cancel

This section applies to consumers in the United Kingdom where the statutory right to cancel a distance contract applies.

Your statutory cancellation right is separate from our voluntary 30-day return policy.

For eligible online purchases of goods, you generally have the right to cancel the contract without giving a reason within 14 days after the day on which you, or a person identified by you other than the carrier, receives the goods.

Where goods from the same order are delivered separately, the applicable cancellation period may run from receipt of the final relevant item in accordance with applicable law.

To exercise your statutory right to cancel, you must communicate a clear statement of your decision to cancel before the applicable cancellation period expires.

Use of the model cancellation form is optional. You may exercise your right to cancel by another clear statement where permitted by law.

12. Returning goods after UK statutory cancellation

Where you exercise your UK statutory cancellation right and we have not agreed to collect the goods, you must send the goods back within 14 days after notifying us of your decision to cancel.

The applicable return instructions are provided in our Returns & Refunds Policy.

Where this has been properly disclosed before purchase and applicable law allows it, the customer bears the direct cost of returning goods following an ordinary change-of-mind cancellation.

This rule does not apply where we are legally responsible for return costs, including where mandatory consumer law provides otherwise.

13. UK refunds following statutory cancellation

Where you validly exercise your UK statutory right to cancel, we will reimburse the payments that must be reimbursed under applicable law.

Where required, this includes the cost of our least expensive standard delivery method.

If you chose a more expensive delivery method than our standard delivery option, we are not required to reimburse the additional amount above the standard delivery cost.

Where legally permitted, we may withhold reimbursement until we have received the goods back or you provide evidence that you have sent them back, whichever occurs first.

Reimbursement will be made using the same payment method used for the original transaction unless you expressly agree otherwise.

We will not charge a fee simply for issuing a statutory reimbursement.

If the value of the goods has been reduced because they were handled beyond what would reasonably be necessary to establish their nature, characteristics, and functioning, we may make a deduction where applicable law permits us to do so.

14. Exceptions to the UK cancellation right

The statutory cancellation right may not apply to certain products or contracts where an exception recognised by law applies.

For example, cancellation rights may be restricted for goods made to the consumer's specifications or clearly personalised.

We will not treat ordinary sale items or discounted products as automatically excluded from statutory cancellation rights.

Where a statutory exception applies to a particular product, the relevant information should be provided before purchase.

15. US change-of-mind returns

There is no general US federal 14-day distance-selling cancellation right equivalent to the UK statutory cancellation regime for ordinary online retail purchases.

US customers may use our 30-day voluntary return policy for eligible ordinary change-of-mind returns.

This voluntary return policy does not limit any rights or remedies that may apply under federal or state law.

16. Faulty, damaged, incorrect, or non-conforming goods

The conditions applying to an ordinary change-of-mind return do not replace your rights where a product is faulty, damaged, incorrectly supplied, unsafe, materially misdescribed, or otherwise non-conforming.

Please provide your order information and enough information for us to identify and assess the issue.

We may request reasonable evidence where necessary, but we will not impose an arbitrary reporting deadline that removes statutory rights.

Where we are legally responsible for defective, incorrect, or non-conforming goods, we will provide the remedy required by applicable law and will not require you to pay costs that the seller is legally required to bear.

UK consumers

For UK consumers, goods must meet the requirements of the Consumer Rights Act 2015, including applicable requirements concerning satisfactory quality, fitness for purpose, and conformity with description.

Nothing in these Terms restricts any remedy available under mandatory UK consumer law.

17. Promotions and discount codes

Promotions, discount codes, and special offers may be subject to separate conditions displayed with the relevant offer.

A promotion may apply only to specified products, order values, customers, markets, or periods.

Promotional offers have no cash value unless expressly stated otherwise.

Expired promotions do not create a continuing entitlement to the promotional price or discount.

18. Website use

You may use Atelierdemarie.com for lawful personal shopping and informational purposes.

You must not knowingly misuse the website by attempting unauthorised access, interfering with its operation or security, introducing malicious code, using the website for unlawful activity, or infringing another person's rights.

We may take reasonable and proportionate steps to protect the website, our customers, our payment systems, and our business from fraud, security threats, or abuse.

19. Intellectual property

Content available on Atelierdemarie.com may be protected by intellectual-property rights belonging to Worldwide Apparel Group LLC or applicable third-party rights holders.

These Terms do not transfer ownership of intellectual property to you.

You may not reproduce, distribute, modify, or commercially exploit protected store content without permission where permission is required by law.

Nothing in this section claims ownership of material that legally belongs to another person or organisation.

20. Third-party services

The store may rely on third-party services to support functions such as payment processing, ecommerce infrastructure, delivery, order tracking, or other store operations.

A third party's own terms may apply when you interact directly with that provider.

The use of a third-party provider does not reduce any responsibility that applicable consumer law places on Worldwide Apparel Group LLC as the contracting seller.

21. Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing in these Terms limits mandatory consumer rights or excludes liability for fraud, fraudulent misrepresentation, death or personal injury where liability cannot legally be excluded, or any other matter that applicable law does not permit us to exclude.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was entered into.

We are also not responsible for losses resulting solely from circumstances outside our reasonable control, subject to any mandatory rights or remedies available to you.

22. Events outside our reasonable control

Circumstances outside our reasonable control may occasionally affect fulfilment or delivery.

Examples may include major carrier disruption, severe weather, natural events, widespread technical failures, governmental action, or similar events that we could not reasonably prevent.

Where such circumstances affect your order, we will take reasonable steps to minimise disruption.

Any mandatory right to cancel, terminate the contract, or receive a refund remains unaffected.

23. Privacy

Personal information collected through Atelierdemarie.com is handled in accordance with our Privacy Policy and applicable data-protection laws.

We do not claim participation in a mediation, arbitration, or alternative dispute-resolution scheme unless that participation has been separately verified and disclosed.

25. Governing law

Worldwide Apparel Group LLC is organised in the United States.

These Terms are governed by the laws applicable to the seller in Wyoming, United States, subject to mandatory consumer-protection laws that apply to you.

If you are a consumer in the United Kingdom or another jurisdiction with mandatory consumer protections, this choice of law does not deprive you of protections that cannot legally be excluded by contract.

Nothing in these Terms requires a consumer to bring proceedings exclusively in Wyoming where applicable law gives the consumer the right to bring proceedings before another competent court.

26. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be applied to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue to apply.

27. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we permanently waive our right to enforce it.

28. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to our store, policies, operations, services, or applicable law.

The latest version will be published on Atelierdemarie.com with an updated revision date.

A later change to these Terms will not retroactively remove rights that already apply to an order you placed before the change.
