This Returns & Refunds Policy explains the voluntary return policy offered by Atelierdemarie.com and the statutory rights that may apply to customers in the United States and United Kingdom.
Atelierdemarie.com is operated by Worldwide Apparel Group LLC.
Our voluntary return policy does not replace or restrict any mandatory rights you may have under applicable consumer law.
1. Our 30-day voluntary return policy
In addition to any statutory rights that apply to you, Atelierdemarie.com offers a 30-calendar-day voluntary return period for eligible products.
The 30-day period begins on the day you receive the relevant product.
To make use of this voluntary policy, you should contact us within the 30-day return period.
This voluntary return period is separate from any statutory cancellation, refund, or remedy rights that apply under consumer law.
2. Starting a return
To start a return, contact:
Please include:
- your order number;
- the name used to place the order;
- the product or products you intend to return; and
- a brief description of the issue where the product is faulty, damaged, incorrect, or not as described.
We will provide the applicable return instructions for your order.
Important: The registered address of Worldwide Apparel Group LLC is not represented as a customer return address. Please do not send a return to the registered address unless we have expressly confirmed in writing that it is the correct return destination for your order.
Contacting us for routing instructions does not make the exercise of any statutory cancellation right subject to our approval.
3. Condition of voluntary returns
For an ordinary change-of-mind return under our voluntary 30-day policy, products should be returned:
- in their original condition;
- unused;
- unworn;
- with original packaging, accessories, or included components where applicable; and
- packaged appropriately to reduce the risk of damage during return transport.
These voluntary-policy conditions do not remove statutory rights relating to faulty, damaged, incorrect, unsafe, or non-conforming goods.
4. Return shipping costs
For an ordinary change-of-mind return under our voluntary return policy, the customer is responsible for arranging and paying the direct cost of return shipping where permitted by applicable law.
Return shipping costs can vary depending on the carrier, destination, shipment method, parcel size, and parcel weight.
We recommend using a return method that provides suitable proof of shipment and retaining that proof until your return has been resolved.
If the product is faulty, damaged, incorrectly supplied, or otherwise non-conforming and applicable law requires us to bear the return cost, we will not require you to pay a cost that is legally our responsibility.
5. Return shipping is separate from the original delivery
The cost of sending a change-of-mind return back to the applicable return destination is separate from the original delivery of your order.
Original delivery charges are refunded only where required by applicable law or where we have expressly agreed otherwise.
UK statutory cancellations are subject to the specific rules explained further below.
6. Refunds under our voluntary return policy
Once an eligible voluntary return has been received and reviewed, any refund due will be issued to the original payment method, unless another method is required by law or expressly agreed with you.
We will process eligible refunds without undue delay after the return has been received and assessed.
Once a refund has been issued by us, please allow up to 10 business days for the amount to appear on your original payment method, depending on your bank, card issuer, or payment provider.
For this payment-processing estimate, business days are Monday through Friday, excluding applicable public holidays.
The additional processing time of your payment provider does not extend any statutory refund deadline that applies to us.
7. Partial refunds or reductions in value
Under our voluntary policy, a returned product that does not satisfy the applicable voluntary return conditions may not qualify for a full discretionary change-of-mind refund.
This does not permit us to make a deduction that is prohibited by mandatory consumer law.
For UK statutory cancellations, the specific handling and diminished-value rules in the section below apply.
8. Exchanges
If you would like a different product or variant, please contact us at info@atelierdemarie.com .
Exchange availability depends on the product and current stock.
Where a direct exchange is not available, you may be asked to return the eligible product and place a new order.
Nothing in this section affects statutory replacement or repair rights that may apply to faulty or non-conforming goods.
9. Faulty, damaged, incorrect, or non-conforming goods
Change-of-mind return conditions do not apply in the same way where a product is:
- faulty;
- damaged on arrival;
- incorrectly supplied;
- materially different from its description;
- unsafe; or
- otherwise non-conforming under applicable law.
If you receive such a product, contact:
Please provide your order number and enough information for us to identify and assess the issue.
We may request reasonable supporting information where necessary, but we will not impose an arbitrary reporting deadline that removes rights given to you by applicable law.
Where we are legally responsible, we will provide the appropriate remedy and will not require you to pay costs that applicable law requires us to bear.
10. United Kingdom — statutory cancellation right
This section applies to UK consumers where the statutory right to cancel a distance contract applies.
This right is separate from our voluntary 30-day return policy.
For eligible online purchases of goods, you generally have the right to cancel without giving a reason within 14 days after the day on which you, or a person identified by you other than the carrier, receives the goods.
Where goods from the same order are delivered separately, the applicable period may run from receipt of the final relevant item where required by law.
11. How UK customers can cancel
To exercise your statutory cancellation right, you must communicate a clear statement of your decision to cancel before the applicable cancellation period expires.
You may do this by emailing:
You may also use our model cancellation form:
Download the Atelierdemarie.com Model Cancellation Form (PDF)
Use of the model cancellation form is optional. You may use another clear statement to exercise your cancellation right where permitted by law.
Exercising a valid statutory cancellation right is not an application that requires our discretionary approval.
12. Returning goods after UK statutory cancellation
Where you validly exercise your statutory cancellation right and we have not agreed to collect the goods, you must send the goods back without undue delay and no later than 14 days after notifying us of your decision to cancel.
Please contact us for the applicable verified return instructions and return destination for your order.
If your order is already in transit when you cancel, we may be unable to stop the delivery. If so, please accept the delivery and follow the return instructions provided.
Contacting us for the correct return routing does not postpone or replace the date on which you exercised your statutory cancellation right.
13. UK return costs
For an ordinary statutory cancellation because you have changed your mind, you are responsible for the direct cost of returning the goods where that responsibility has been properly disclosed and applicable law permits it.
This does not apply where the goods are faulty, damaged, incorrect, or otherwise non-conforming and applicable law requires the seller to bear the relevant cost.
14. UK statutory refunds
Where you validly exercise your UK statutory right to cancel, we will reimburse all payments that applicable law requires us to reimburse.
Where required, this includes the amount paid for our least expensive standard delivery option.
If you selected a delivery service that was more expensive than our standard delivery option, we are not required to reimburse the additional premium above the standard delivery cost.
Where we have not offered to collect the goods, we may withhold reimbursement until:
- we receive the goods back; or
- you provide evidence that the goods have been sent back,
whichever occurs first.
The reimbursement will be made without undue delay and within the applicable statutory deadline.
Where goods are returned by you, this is generally no later than 14 days after the day we receive the goods back, or, if earlier, no later than 14 days after the day you provide evidence that you sent them back.
We will use the same payment method you used for the original transaction unless you expressly agree to another method.
We will not impose a fee merely for making the statutory reimbursement.
15. UK handling and diminished value
UK consumers may inspect goods in a way that is reasonably necessary to establish their nature, characteristics, and functioning.
Where permitted by law, we may make an appropriate deduction from a statutory refund if the value of the goods has been reduced because of handling beyond what would reasonably be permitted when examining the goods in a shop.
16. UK statutory exceptions
The statutory cancellation right does not apply in every circumstance.
Relevant legal exceptions may include, where the statutory conditions are satisfied:
- goods made to the consumer's specifications or clearly personalised; and
- sealed goods that are not suitable for return because of health protection or hygiene reasons where the seal has been broken after delivery.
We do not automatically exclude an ordinary product simply because it was sold at a discount or during a sale.
Where an applicable statutory exception applies to a particular product, the relevant limitation should be disclosed before purchase.
17. UK faulty or non-conforming goods
The statutory cancellation provisions above are separate from your rights where goods do not conform to the contract.
UK consumers have rights under the Consumer Rights Act 2015, including applicable rights where goods are not of satisfactory quality, are not fit for purpose, or do not match their description.
Nothing in this policy restricts those statutory rights or remedies.
18. United States customers
There is no general US federal 14-day distance-selling cancellation period equivalent to the UK statutory cancellation regime for ordinary online retail purchases.
Eligible US customers may use our 30-calendar-day voluntary return policy for ordinary change-of-mind returns.
This voluntary policy does not limit any additional rights or remedies that may apply under federal or state law.
19. Refusing delivery
Refusing or failing to accept a parcel does not by itself necessarily communicate a valid cancellation of the contract.
If you no longer want an order, please contact us so that your cancellation or return can be recorded and handled correctly.
For UK consumers, this does not prevent you from exercising a statutory cancellation right by providing a clear statement within the applicable cancellation period.
20. Products returned without identifying information
Please include enough information with your return for us to identify the relevant order.
A return that cannot reasonably be matched to an order may take longer to process.
This administrative requirement does not extinguish a statutory right where the customer has otherwise validly exercised that right.
21. Payment disputes and chargebacks
If you believe a refund or order issue has not been resolved correctly, please contact us first so that we have an opportunity to investigate and resolve the matter.
Nothing in this section removes any legal right you may have to contact your payment provider, card issuer, or other appropriate authority.
